These Terms of Service (the "Terms") set out the conditions for using My Baseball Stats, including the web version and the iOS app (the "Service"), provided by an individual developer (the "Operator"). By using the Service, you (the "User") agree to these Terms.
1. Scope
These Terms apply to all matters relating to your use of the Service. The Privacy Policy forms part of these Terms.
2. Accounts
- You must register your account with accurate information.
- You are responsible for keeping your sign-in credentials secure and must not let anyone else use your account.
- Except in cases of willful misconduct or gross negligence, the Operator is not liable for damages caused by inadequate management of your credentials or their use by a third party.
3. Teams and Members
You can create a team in the Service and invite other users as members to share stats. Team admins can invite members, change their roles, and change the team's visibility settings, and are responsible for those actions. If a team is made public, its game results and related information can be viewed by anyone, including people who are not signed in.
4. Paid Plans
- The Service offers features available for free and a paid plan. The price and content of the paid plan are as shown in the Service.
- Payments for paid plans on the web version are processed by Stripe, Inc. by credit card or other supported methods. The paid plan is billed yearly and automatically renews each year until canceled. The price applied when you signed up (including limited-time prices such as the founding team price) continues to apply on renewal for as long as the subscription is not canceled.
- You can cancel at any time from "Manage billing" on the team management page. After canceling, you can keep using the paid plan until the end of the period you have already paid for.
- Except as required by law, fees already paid are non-refundable.
- Features purchased through the App Store in the iOS app are subject to Apple Inc.'s terms and procedures.
5. User Data
- Rights to the data you enter or upload to the Service (such as player names, game stats, and images) belong to you or the rightful owner.
- The Operator stores and uses this data only as necessary to provide, maintain, and improve the Service.
- When registering names or images of players or others, you must take care not to infringe the rights of third parties, for example by obtaining their consent where appropriate.
- The Operator works to keep your data safe, but we recommend that you also keep your own records of important data.
6. Prohibited Conduct
When using the Service, you must not:
- Violate any law or public order and morals
- Infringe the rights, reputation, or privacy of other users or third parties
- Register or use an account by impersonating another person
- Place excessive load on the Service's servers or network, or access or attempt to access it without authorization
- Interfere with the operation of the Service, or engage in any other conduct the Operator deems inappropriate
7. Suspension and Account Deletion
If you violate these Terms, the Operator may suspend your use of the Service or delete your account without prior notice. You can delete your account at any time from the settings screen.
8. Changes to, Interruption of, and Termination of the Service
The Operator may change or interrupt all or part of the Service without prior notice for maintenance, outages, or other unavoidable reasons. The Operator may also end the Service after announcing it in the Service a reasonable period in advance.
9. Disclaimer
- The Operator does not warrant that the Service is free of defects in fact or in law (including safety, accuracy, fitness for a particular purpose, errors, and bugs).
- Stats and metrics calculated by the Service are reference values based on the data entered, and the Operator does not guarantee their accuracy.
- Except in cases of willful misconduct or gross negligence, the Operator is not liable for damages arising from your use of the Service. Where the Operator is liable, its liability is limited to the fees you paid to the Operator in the month the damage occurred. This does not apply where such exclusions or limits are not permitted by the Consumer Contract Act of Japan or other applicable laws.
10. Changes to These Terms
The Operator may change these Terms when it deems necessary. The updated Terms take effect as soon as they are posted on this page. We will announce material changes in the Service in advance.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Operator's place of residence as the court of first instance.
